MEMBERSHIP TERMS

Acceptance of Terms

By using Peak Fitness facilities or services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Membership Terms

Membership Types and Fees

  • Annual memberships require a 1-year commitment
  • Month-to-month memberships require 30-day written notice for cancellation
  • Enrollment fee of $49.00 applies to new memberships with 1-year agreement
  • All fees are non-refundable unless otherwise specified

Payment Terms

  • Monthly fees are due on the same date each month as your enrollment date
  • Late fees may apply for overdue payments
  • We accept credit/debit cards and automatic bank drafts
  • You are responsible for keeping payment information current

Facility Rules and Conduct

General Rules

  • Members must be 18+ for 24/7 access; minors require adult supervision during staffed hours
  • Proper athletic attire and closed-toe shoes required
  • Clean up after yourself and wipe down equipment after use
  • No outside food or beverages (water bottles permitted)
  • Respect other members and staff at all times

Prohibited Activities

  • Harassment, intimidation, or inappropriate behavior
  • Use of tobacco, alcohol, or illegal substances
  • Bringing guests without proper guest passes
  • Commercial photography or filming without permission
  • Misuse or damage of equipment

Liability and Assumption of Risk

IMPORTANT NOTICE:

Exercise and use of fitness equipment involves inherent risks. By using our facilities, you acknowledge and assume all risks of injury or harm.

  • Peak Fitness is not liable for injuries sustained on the premises
  • You exercise at your own risk and are responsible for your own safety
  • Consult with a physician before beginning any exercise program
  • Report any equipment malfunctions or safety concerns immediately

Cancellation and Termination

Member-Initiated Cancellation

  • Annual memberships: Early cancellation may result in fees
  • Month-to-month: 30-day written notice required
  • Cancellation requests must be submitted during staffed hours
  • No refunds for unused portions of membership

Gym-Initiated Termination

  • We reserve the right to terminate memberships for rule violations
  • Non-payment may result in membership suspension or termination
  • Terminated members forfeit all membership privileges

Personal Training and Classes

  • Personal training sessions must be cancelled at least 24 hours in advance
  • Class reservations should be cancelled at least 2 hours before class time
  • Repeated no-shows may result in booking restrictions
  • Personal training packages are non-refundable and non-transferable

Privacy and Data Protection

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on our website and take effect immediately upon posting. Continued use of our services constitutes acceptance of modified terms.
